What Is DOT Compliance?
The U.S. Department of Transportation requires employers in safety-sensitive industries to maintain federally mandated drug and alcohol testing programs under 49 CFR Part 40. This applies to commercial truck drivers, airline employees, pipeline workers, transit operators, railroad workers, and maritime personnel.
Non-compliance carries serious consequences — civil penalties, loss of operating authority, and liability exposure in the event of an accident. A properly managed DOT testing program protects your employees, your business, and the public.
Employer Obligations Under 49 CFR Part 40
- Maintain a written drug and alcohol testing policy
- Use only DOT-certified collectors and SAMHSA-certified laboratories
- Designate a Designated Employer Representative (DER)
- Enroll safety-sensitive employees in a random testing pool
- Provide supervisor reasonable suspicion training (60 min drug / 60 min alcohol)
- Maintain required records for a minimum of 1–5 years depending on record type
- Report Management Information System (MIS) data annually when required
- Use a qualified Medical Review Officer (MRO) to review all lab results
Required Testing Categories
Pre-Employment
Every safety-sensitive employee must pass a DOT drug test before performing covered functions for the first time. No exceptions.
Random Testing
Employers must conduct unannounced random testing throughout the year at federally mandated minimum rates — currently 50% for drugs and 10% for alcohol in most DOT agencies.
Post-Accident
Following certain accidents, DOT requires drug and alcohol testing of involved employees within strict time windows — 2 hours for alcohol, 8 hours for drugs.
Reasonable Suspicion
When a trained supervisor observes signs of impairment, the employer must direct the employee to testing immediately. Supervisor training is a federal requirement.
Return-to-Duty
Employees who violated DOT drug or alcohol rules must complete a SAP evaluation, follow-up treatment, and pass a return-to-duty test before resuming safety-sensitive duties.
Follow-Up Testing
After returning to duty, employees are subject to unannounced follow-up testing for a minimum of 12 months — up to 60 months at the SAP's discretion.

Random Draws
We conduct quarterly random selections at federally required rates, notify your DER of selected employees, and coordinate collection scheduling.
Collection & Lab
Our certified collectors perform the collection using federal CCF forms. Specimens are sent to a SAMHSA-certified laboratory for analysis.
MRO Review
A certified Medical Review Officer reviews all laboratory results, contacts donors on non-negative results, and issues the final verified result.
